摘　　要：美国欠缺行为能力成年人之关系权学说经过多年的发展日趋完善。它从社会关系学的角度来分析了成年人监护的设立、被监护人权利的维护以及终止监护的条件。独特的分析角度、严密的逻辑性、富有实效的操作规范使得它具有高度的研究价值,为成年监护法律制度的发展做出了巨大的贡献。鉴于我国高龄智障者日益增多,我国仅限精神病人为成年监护的对象,完全无法利用该制度保护其利益。现行条文不仅不能解决所有问题,且法律条文规定过少,非常有参照外国立法修正本国立法的必要。The relationship rights of incompetent adults in the U.S.become more and more mature by developing for many years.It analyses the establishment of guardianship for adults,the rights protection to incompetent and the conditions of terminating guardianship from the perspective of social relations.The unique view of analyses,strict logic and actual effect of practical operation norms make it a high degree of research value,and has made great contributions to the development of legal system of adult guardianshi...
