美国成年监护制度改革之动因及对我国的启示

摘　　要：进入新世纪,人口老龄化已经是一个全球性的问题。中国作为占世界人口五分之一的人口大国,老龄化来势迅猛,通过法律手段建立完善成年监护制度就极为必要。但是我国目前保障欠缺行为能力人合法权益的立法仍不够完善。而大陆法系以及英美法系各国接收吸纳国际化新理念,对其成年监护制度进行大刀阔斧的改革,以顺应国际潮流并切实保障欠缺行为能力成年人的合法权益。这对我国有非常重大的借鉴意义。The aging of the population is already a global problem. China has a large population which accounts for one-fifth of the world s population. The speed of aging is so fast that it is necessary to establish a sound system of adult guardianship by means of the law.
