我国外贸代理制度的立法缺陷分析

摘　　要：外贸代理制度自实行以来,在我国进出口贸易中发挥了不可替代的作用。但由于我国法律规范缺乏、外贸代理的内在运行机制不健全等诸多因素的影响,我国外贸代理制度不断暴露出自身的不足和缺陷,以致外贸代理目前在我国的推广十分受限。本文剖析了我国外贸代理制的立法缺陷,并提出了相应的对策建议。Since China adopted trade agency system,the importation and exportation have developed rapidly.Yet it still confines to certain fields,due to lack of relevant laws and regulations,the imperfect agency mechanism of China,etc.The article analyzes the underlying legislative defects of domestic trade agency system,and proposes corresponding countermeasures.
