摘　　要：确保植物新品种的不断推出是加强我国农业国际竞争力的有效措施之一。植物新品种有别于一般知识产权的客体,需要进行特殊的立法予以保护。目前世界上主要存在多轨制保护模式及专门法保护模式两种不同的模式,各国在品种权及其限制的具体内容上也各有相异之处,我国亦具有自己的特点,完善现有法律制度,以更好地为农业经济的发展服务。Continually issue the new plant variety is an effective measure to strengthen our country's competitiveness in agriculture.The new plant variety is different from ordinary intellectual property.It needs special legislation.Nowadays,there are two main mode in the world,the multiple protection mode and the protection mode by the special law.Each country has its different traits in the plant variety right and its limit.Our country has its specialty,too.We should perfect the exisiting legal system,in order to serve the development of the agricultural economic.
