摘　　要：迁徙自由具有基本人权性质,是我国社会主义市场经济体制建立的一个重要条件,也是解决其它社会问题的关键因素,理应入宪。迁徙自由在实现途径上权利赋予与制度保障应衔接进行。The Freedom of migration belongs to the fundamental civil rights. It is an essential condition for the construction of Chinese socialist market economy as well as a key factor to the solutions of other social problems. So citizens' freedom of migration should have its place in Chinese constitution. In the process of realizing the right, the constitutional legislation should be accompanied by the construction of the related legal systems.
