摘　　要：合理使用制度是知识产权权利限制体系中的重要组成部分,但在我国商标法中对此只作出比较原则的规定。本文从商标合理使用的含义及分类入手,探析商标合理使用制度建立的正当性及其构成要件,并针对我国商标合理使用制度的立法现状,提出我国商标合理使用制度的建设构想。The system of the fair use is an important part of a system of restrictions on the intellectual property rights.However,our trademark law only makes some basic provisions.Based on the definition of the fair use and the classification,the article explores the legitimacy of establishing the system of the fair use of trademarks and its components and also,considering the legislation status of the system of the fair use of trademarks,puts forward some ideas for constructing the system in China.
