摘　　要：本文在简要介绍涉外贴牌生产历史发展及我国现状的基础上,阐述我国涉外贴牌生产商标权侵权纠纷类型并探讨其中的侵权认定,并就其中几种争议较大的涉外贴牌生产情形不宜认定为商标侵权,提出了自己的观点。This paper presents the historical development and our country's status quo of OEM,describes the types of trademark infringement of OEM,explores the determination of infringement of OEM's trademark rights and attempts to provide some proposals relating to the situation of OEM which has been holding more disputes and should not be regarded as trademark infringement.
