现行责任限制程序规则在司法实践中的困惑及解决

摘　　要：由于《海诉法》仅规定了设立基金程序,未规定责任限制诉讼程序,导致实践中出现了许多问题。分析了司法实践中令人困惑的10个问题,以设置责任限制程序规则的立法宗旨为衡量标准,对现行责任限制程序规则进行了评价;针对司法实践中出现的亟须解决的问题,提出了弥补现行设立基金程序缺陷的处理意见及完善责任限制程序的建议。Many problems occur in the judicial Practice because Maritime Procedure Law of the PRC only provides the proceedings of constitution of limitation fund and do not provides the proceedings of limitation of liabiltiy for maritime claims. Firstly, the paper analyses 10 bewildering problems in the judicial practice.Secondly, the paper evaluates the current procedural rule of limitation of liability in contract with the legislative popurse of the procedural rule of limitation of liability.Thirdly, in accordance with the urgent solution to the problem, the paper delivers some opinions about perfecting defect of the current proceedings of constitution of limitation fund.Lastly, on the basis of summarizing the judicial practice and referring to the advanced legislation in the world, the paper puts forward certain suggestions on perfecting the proceeding of limitation of liability.
