摘　　要：通过解释和评价英国法关于海上货物运输合同托运人对承运人的诉权问题的规定,分析了解决我国司法实践中存在的相关问题的办法,对海商法有关内容的修订提出了意见和建议。The paper points out the lacuna and summarizes the main issues experienced in judicial practice in China with regard to the shipper's rights of suit against the carriers under the contract of carriage of goods by sea; Then it gives a detailed analysis and examination to the related provisions in the 1992 COGSA; Based upon such a comparative study, the paper recommends legislative advice in respect of shipper's rights on the reformation of the Chinese Maritime Code.
