摘　　要：以刑罚执行为核心范畴的理论体系停留于对监狱制度的实然性描述和注释,使之不能适应监狱法治建设的需要,以监狱、行为、责任三位一体的范畴理论体系在某种程度上可以弥补这一缺失批判功能的缺陷,并为监狱制度的变革提供指导方向。The theoretical system with penalty as key category stays at description and explanatory note of the prison , which is unable to meet the need of the legal construction of the prison. The theoretical system with the prison, behavior and responsibility as one can to a certain extent remedy this defect ,the criticizing function'disappearance, offer the direction of the revolution of the legal system in prison.
