摘　　要：将保险代位权界定为损害赔偿请求权的法定移转,保险代位权的法律性质,保险代位权在实践中产生的侵权责任的实现落空问题,保险赔偿机制对侵权损害赔偿机制的影响与实际取代正是由于侵权责任制度自身无法克服的缺陷所致。This paper is based on the analysis of the legal nature of the insurance subrogation,and its premise is the insurance subrogation should be defined to the legal transfer of the claim for damages,and this paper analyzes the problem that the failure of the realization of tort liability in the practice of the insurance subrogation.It is pointed out that the influence and actual replacement of insurance compensation on tort compensation,which results from the insuperable limitation of tort liability system.
