论我国前科消灭制度现实化的限度——基于宽严相济刑事政策的思考

摘　　要：我国前科消灭制度现实化的过程,也是我国刑事法制现代化的过程。我国前科消灭制度现实化的路径应是在内部机会成熟、外部刺激与影响下启动的混合型的刑事法制现代化的路径。我国前科消灭制度现实化的限度只能在宽松刑事政策下建构,严厉刑事政策视野下前科消灭的现实化时机仍不成熟。The process of our criminal record system elimination,is also the process of criminal law modernization.The basic path of our criminal record system elimination,should be in-house criminal law modernization,under our nation internal mature and the influence of external stimulation.The limit of our criminal record system elimination can only be constructed in the loose criminal policy.The criminal record system elimination in severe criminal policy is still premature.
