摘　　要：自1949年第一部宪法性文件《共同纲领》颁布以来,新中国的宪政进程也进行了60年,比较建国以来我国颁布的几个宪法文本,我们不难发现,即使是语气比较"刚猛"的1975年《宪法》,在其内容上也存在着一些不具有实际约束力的、宣言性的条款。无论是宪法文本本身还是"软条款"只有贴合了本国的实际情况、符合了时代背景,同时能够得到很好的实施和保障才能够构建一个相对完善的宪政制度。Since the first constitutional document Common Programme promulgated in 1949,Chinese constitutional course has been carried out for 60 years.Having compared several versions of our constitution,it is easy to be found that there are some provisions which are hardly actual binding and declaratory in the content of the constitution promulgated in 1975,thoung it is poweful.Both the constitutional text itself and "soft terms" have to fit the actual situation in their countries,and fit the historical background,w...
