摘　　要：国有资产流失犯罪并非我国刑法明确规定的一类罪或个罪,而是我国经济犯罪中以国有资产为直接侵害对象,造成各类国有资产重大损失的犯罪类型。此类犯罪有特殊的内涵、特点和发展趋势,在查处过程中也呈现出与其他经济犯罪不相一致的特点,需要健全完善法律法规,结合刑事、民事以及行政的力量共同打击和防范。Drain on State-owned assets offence is not a crime stipulated in the Criminal Code of China,but it is a kind of offence which targets on state-owned assets and drain them in economic crimes of China.This type of crime has special characteristics and trends,and also presents features not consistent with the other economic crimes.To fight against and prevent it,laws and regulations have to be improved,and criminal,civil and administrative legal powers have to be integrated.
