摘　　要：侵权责任与违约责任作为医疗损害赔偿责任的现实形态,其运用往往依个案的不同而有所取舍,请求权是可以选择的,而法律适用通常不能选择。在经济赔偿方面,无论医疗损害责任承担方式如何选取,都要紧紧把握经济赔偿额与责任主体的责任程度、患者的病损程度以及医疗事故等级相适应的基本原则,从而最终实现医患关系的和谐互动。Tort liability and liability for breach of contract as the actual formations of compensation responsibility for medical damage,the application is different according to the different cases.The claim can be chosen,but application of law can t.No matter how to select the mode of bearing legal responsibility of medical damage,the amount of financial compensation should firmly grasp the duty degree of responsibility subject,the lesion degree of patients as well as grading of medical damage corresponding to the ...
