摘　　要：我国已经步入老龄化社会,老年人犯罪问题在当今社会具有一定的典型性。无论是从刑事责任与年龄的关系、社会对老年人犯罪的宽容态度来看,还是从刑法的机能、刑罚目的方面来看,对老年人犯罪予以从宽处罚的做法势在必行。China has entered the aging society,the elderly crime has a certain typical in today's society.Either from the relationship between age and criminal responsibility,social tolerance for elderly crime,or from the function of criminal law,the purpose of punishment,lenient punishment of the elderly crime is imperative.
