英国令状制度研究——兼论传统的价值

摘　　要：以令状制度为基础形成和发展起来的英国普通法具有浓厚的历史意味,英国法律文化的诸多特征均源自于令状制度,对该制度进行历时性考察可以解释传统在英国法律文化形成过程中的重大意义。令状制度是特定民族文化和时代背景的产物,反过来又型塑和强化了英国的法律文化。中国正处于经济高速发展、社会矛盾凸显、法治建设亟待完善的时期,应该适时地对传统法律文化中有价值的因素给予关注与考量,重视传统与现代之间的关联。The English common law which formed and developed on the basis of the writ system has a strong historical meaning,and lots of features of English legal culture are derived from the writ system.To have a diachronic study of the system can explain the significance of tradition during the formation of the English legal culture.The writ system was a product of the specific cultural and ethnic background.On the other hand,it shaped and strengthened the English legal culture.Now China is in a period of rapid economic development,frequently emerging social conflicts and law improvement,and therefore valuable factors from traditional legal culture should be emphasized,and the relationship between tradition and modern times should be emphasized,too.
