摘 要:房屋优先购买权的行使条件是承租人行使优先购买权的必备前提,我国相关法律对于行使条件应如何适用的规定过于笼统和原则,缺乏可操作性。应在兼顾承租人与出租人双方利益的基础上,运用限制解释和扩充解释的方法重新审视行使条件,明确房屋优先购买权必须以合法租赁关系为前提、让利方式下不适用同等条件、未约定排除优先购买权行使三个限制条件,以及"承租人"可包括特殊关系人;出卖限于有偿,但有偿不限于现金支付两个扩充解释,以完善房屋承租人优先购买权行使条件的适用。The conditions of implementation of the house lessee' purchase priority is essential premise of the implementation of the house lessee' purchase priori,but correlational law regarding the condition of the house lessee's purchase priority in our country is too general and principle,which lacks the feasibility.This article gives dual attention to both sides benefit of the tenant and the lesser,using the method of limit explained and expand the explanation to carefully examine the condition.In order to amend the house lessee's purchase priority,suggest three limited conditions that the house lessee's purchase priority have to take legal contract of tenancy as premise,discount sale is not suitable to the same level condition,has not agreed the elimination of the house lessee's purchase priority beforehand and two expanded explanation that special relationship persons can be contained as tenant and sale is restricted in paid,but paid is not restricted in the cash payment.
