摘　　要：检察机关参与监督民事诉讼受"公共利益"保护、检察职权配置、民事诉讼结构等因素的影响。在现行法律框架内,应在诉讼制度和国家制度两个层面上完善检察机关以法律监督者身份介入民事诉讼的方式,同时探索检察机关以法律监督者以外的身份介入民事诉讼的方式。That the procuratorial organs participate and supervise the civil litigation is affected by how to protect public interest,allocation of procuratorial authority and the structure of civil litigation.The procuratorial organs participate in civil litigation as the supervisor in two ways that is litigation and national system.Under the current Legal system,it is necessary to perfect them.Meanwhile,it is necessary to explore ways that the procuratorial organs participating the civil litigation in other roles.
