摘　　要：近年来我国医疗纠纷日益增多,医患关系日趋紧张,许多地方进行了多元化解决医疗纠纷的实践探索,其中第三方居中调解医疗纠纷的非诉讼模式受到重视,出现了专业机构主导、保险机构主导、人民调解主导、政府三级网络主导的医疗纠纷第三方调解机制.这些机制都得到了政府的大力支持,具有第三方身份中立、调解免费、转移医疗纠纷处理现场到医院外等特点,较好地达到了促进医疗纠纷尽快、有效解决的目的.但是这些机制也存在缺乏可持续发展的保障机制、调解机构及调解协议的法律地位不明确、以赔偿息事宁人的现象.因此应从立法引导调解,明确调解机制的法律地位；构建调解机制的公正程序以保证结果公正；促进调解机制与专业团体合作,重视医疗纠纷的教育与预防；促使调解机制与医疗责任保险相结合,纠纷处理与救济并重几个方面进行完善.Medical disputes have been increased in recent years in China which cause the tension in the doctor-patient relationship．In many areas ，people have conducted practical exploration on muhifaceted dispute-settlement method．Greatimportance has been attached to the non-lawsuit model of the third- party mediation which could be generally divided into the following types：the mediation oriented by professional organizations，the mediation oriented by insurance company，the mediation oriented by People' s Mediation and the mediation oriented by the three-level government. Government supports all these mechanisms greatly with the purposes of establishing a bridge of understanding between doctors and patients，emphasizing the status of the third- party，providing free mediation，transmitting the medical dispute scenes to outside the hospital as well as promoting a rapid，effective solution to the medical disputes. Howe er,some negative phenomena also exist such as：the lack of sustainable guarantee mechanism。the indeterminate legal status of the mediation institutions and mediation agreements ，patching up a quarrel by only compensation．The improvements should be conducted on following aspects：1 define the status of mediation mechanisms by legislation．2 set up fair-and-square procedures to insure a just consequence．3 promote the combination between the mediation mechanisms and professional organizations and focus on the education and prevention of medical disputes；4 integrate the mediation mechanisms with medical liability insurance as well as place equal importance on settlements and redress of medical disputes.
