摘　　要：近些年来,国际投资领域出现新兴国家对外投资崛起、国际投资争端频发、看待国际投资态度转变等新的变化,国际投资规则的内容、结构也在经历深刻的变化,国际投资规则发展正处在关键的"十字路口"。中国自实施"走出去"战略以来,已经从单纯的资本输入大国转变为兼具"主要资本输入"和"重要资本输出"双重地位的国家,中国应加快在投资规则中的立场转换,提升投资保护待遇,逐步引入企业社会责任条款,平衡东道国和投资者的权利和义务。In recent years,many new changes are emerging in the domain of international investment,such as the rise of outward foreign direct investment from emerging countries,the frequent occurrence of international investment disputes and the changing attitude to international investment.The content and structure of the international investment agreements is also undergoing profound changes,international investment agreements are at the 'crossroads'.Since the implementation of the strategy of 'going out',China has evolved from the pure capital input country into a 'major capital input country' and 'important capital output country',China should speed up the position-changing in the foreign investment rule-making,improve the investment protection treatment,gradually introduce corporate society responsibility standards,balance the rights and obligations between the investors and the host country in the investment agreements of China.
