摘　　要：《侵权责任法》中确定了惩罚性赔偿制度,且在药品侵权中引入该制度。本文通过对惩罚性赔偿的主张方式、惩罚性赔偿可否与一般赔偿分开主张、不真正连带人是否承担惩罚性赔偿等进行分析,得出在实际运用中惩罚性赔偿的程序,旨在为惩罚性赔偿制度在药品侵权领域的应用提供一定的参考。The Tort Liability Law contains the punitive compensation system,and is introduced into the drug infringement.This article analyzes the punitive damages' claims,whether punitive damages and general damages can be advocated separately,whether untruthful joint person should bear the punitive compensation and so on.The study investigates the practical punitive compensation procedures to provide certain reference for the application of punitive compensation system in the drug infringement.
