摘　　要：移植他国先进的法律,我们必须正确认识处理好本民族法律传统文化与法的现代化、国际化的矛盾,从而促进本国法律的 现代化。While we are trying to transplant foreign laws into our native land, we must deal with the contradiction between the traditional culture of native law and the modernization & internationalization of the law.
