摘　　要：对于警察开枪前的鸣枪警告行为,理论界存在分歧,不同国家的立法规定也不尽相同。基于鸣枪警告利弊兼有、危险性较大的特点,我国立法应当明确规定其适用条件和具体要求,以更好地规制警察鸣枪警告行为,减少人员伤亡和财产损失。As to the police behavior of warning shots before firing,scholars have different opinions, and legislations and policies of different countries vary.Warning shots have advantages and disadvantages,and are of high risks,so the legislations of China should specify its applicable conditions and operating rules,in order to better regulate the police behavior of warning shots,and reduce the casualties and property loss resulting from warning shots.
