体育法的价值研究评述

摘　　要：体育法的价值研究属于体育法的基础理论研究,随着体育法学不断成熟和完善,越来越多的学者开始关注体育法的价值问题。我国学者在进行体育法的特征研究、体育法研究方法的研究、《体育法》修改理念的研究和体育权利的研究过程中都会涉及体育法的价值研究,在国外,体育法的价值是相关著作中所必需涉及的问题,学者们都是集中某一层次或某一种价值的研究。而无论国内和国外,体育法的价值冲突、价值评价、价值实现等问题学界还少有人进行研究,这些问题应该在今后体育法的价值研究中给予充分的重视。The value of sports law belongs to foundational theoretical research of sports law.With the growth of sports law,more and more scholars begin to attach importance to the research of value of sports law.It is summarized in this article the main research results both domestic and oversea.In our country,the scholars would relate to the research of value of sports law when they are in the research of characteristic and research method of sports law,modification concept of 'Sports Law of the People′s Republic of China' and sports rights.On the other hand,some scholars carry out special research into the value of sports law.In other countries,almost all scholars would attach importance to value of sports law,and relate to it in their bookmaking.The scholars research value of some arrangement.The researches on conflict,evaluation and realization of value of sports law is less attended at home and abroad,which should be regarded as keystone of the research.
