摘　　要：非物质文化遗产档案开发利用的根本目标在于保护非物质文化遗产,但在现实开发利用中存在许多问题。相比档案学意义上和行政保护模式下的开发利用,建立在知识产权法体系下的开发利用模式可形成有效内部激励,增强非物质文化遗产自身生命力,并可提供档案利用控制机制。并提出知识产权法体系下非物质文化遗产档案开发利用的基本原则,包括分类开发利用原则、利益平衡原则、激励创新原则。The basic target of the exploitation to the intangible heritage archives is to protect intangible heritage.But there is many problems in the course of exploitation.The mode of exploitation based on the intellectual property law system is better than the modes of exploitation based on the archives and administrative protection,because it can form an effective inner incentive mechanism,and enhance the life of the intangible heritage itself.And it can provide a kind of control mechanism to archives exploitation.Then suggest the general principles of exploitation to intangible heritage archives in intellectual property law system.It includes the principle of classification exploitation,the balance of interests,incentive innovation.
