摘　　要：改革开放以来,我国公安机关在机构设置方面总体上是符合主体发展规律的。但从新修订的刑事诉讼法及相关法律规范来看,仍存在着法律规定不统一、效力不高、不详细且有相互矛盾之处等问题,这种混乱也导致了实践中公安机关内部侦查机构的侦查权和行政管理权相互交错、权力滥用以及滥设"行业公安"的现象。要改变这种现状,必须由法律统一规定公安机关各侦查机构及其人员组成,并努力向"大侦查机构"方向迈进。只有这样,才能使公安机关机构设置得更加合法和合理,走向法治化和科学化,同时彰显刑事诉讼惩罚犯罪和保障人权、公平和效率的统一。Since China's opening-up to the outside world,the structural establishment of public security organs in China has adapted to the principle of major development in general while there still exists some problems,such as the disunity of legal provision,low efficiency,self-contradictory and so on.These problems may result in the phenomena of overlap of investigation power and administration power,power abuse,etc.In order to change the current situation,the investigation organs and their personnel shall be established according to law and makes progress towards 'large investigation organization'.Only in this way can the structural establishment of public security organs tend to be fair,rational,legalized and scientific.
