论民法精神对公安立法工作的影响

摘　　要：公安工作的根本宗旨是为人民服务,其重要内容不仅是保障公共利益,而且要保障人民的基本民事权利。这就要求公安立法工作要体现和尊重民法精神。同时,民法也具有社会安全保障的功能,这就为公安立法工作中适用民法精神提供了契机。当前,公安立法工作中,对于民法精神的认识还存在诸多误区,公安立法工作应当在立法形式、立法宗旨等方面借鉴、适用民法精神,从而完善公安立法工作。Serving the people is the fundamental purpose of public security work.Its important task is not only to safeguard public interest,but also to protect the basic civil rights of the people.Public security legislation is required to reflect and respect the spirit of the civil code.Meanwhile,civil law also has the function of safeguarding social security and civil law spirit has provided the opportunity for the public security legislation to apply this spirit.Currently,there are some misunderstandings of the civil law spirit in the process of the public security legislation.Therefore,there are some improvements to make in the legislation work,respecting the form and the purpose of the legislation.
