摘 要:行政执法与刑事司法衔接机制在实践中被简称为"两法衔接"机制,它是当初为了解决行政执法与刑事司法两个环节脱节的问题而在改革实践中应运而生的,其现实意义重大。但是在新疆等地的调研可见,在"两法衔接"机制的改革探索中也暴露出了诸如责任不清、效率不高及地区间发展不均衡等问题。而总结各地改革中的问题与经验并将其上升为立法,明确检察机关在"两法衔接"机制中的主导地位,已经势在必行。Administrative law enforcement and criminal justice link-up mechanism is called 'two-law linkup' in short in practice.It comes into being as a response with a solution to separation of administrative law reinforcement from criminal justice in reform,with great realistic significance.However,the survey made in Xinjiang shows that reform attempts in 'two-law linkup' mechanism also reveal some problems,such as:indefinite definition of obligation,less efficiency and regional unbalanced development.Besides,it has become an inevitable trend to conclude the problems and experience in all parts which might be put into legislature and define the dominant position of procuratorial organ in 'two-law linkup' mechanism.
