摘 要:司法鉴定体制改革过程中因侦查机关对司法鉴定管理权的抵制以及审判机关对司法鉴定管理权的干扰,使得涉及此领域中的不同权力之间出现纷争,以至于法律确定的统一司法鉴定管理体制历经七年之久仍未形成。其主要治理对策为:侦查机关的鉴定机构与实施侦查部门实施分离,与社会鉴定机构平等地接受司法行政部门的统一管理,并借助于反对解释的力量限制侦查权力钳制司法鉴定管理权的弹性空间;在制度上,立法应果断地回应审判机关对司法鉴定管理权的侵蚀,保障司法鉴定管理权能够依法有效地运行,使司法鉴定体制改革走出困境。Disputes emerge among different powers in judicial appraisal during the process of judicial appraisal reform,due to the investigation organs' resistance to and the courts' interference with the right of judicial appraisal,so that the legally-established uniform judicial appraisal management system has not yet formed for five years.The main countermeasures are:the appraisal organizations of the investigation organs are separated from the investigation departments and administrated equally under the unified management with social appraisal organizations,and are limited the flexibility to control judicial appraisal by means of the force against interpretation.From the perspective of the system,the legislation should respond to the courts' attitude towards judicial appraisal,to safeguard the efficient operation of judicial appraisal,and to make the judicial appraisal system out of the predicament.
