继承回复请求权若干法律问题研究

摘　　要：继承回复请求权是继承人因他人否认其继承权且无权占有遗产的全部或部分时的原状回复请求权。继承回复请求权兼具形成权与请求权的性质。在共同继承时,行使继承回复请求权属于遗产保存行为,因此无须全体共同继承人协商一致。继承回复请求权可以被继承、扣押,但由于继承回复请求权之诉需要确认继承人之资格,因此无法被代位行使。继承回复请求权为特别请求权,尤其是原被告间争执继承人的继承资格时,应以继承回复请求权优先适用。为了从速确定财产秩序关系,继承回复请求权应受诉讼时效的限制,时效期间应继续坚持《民法通则》、《继承法》关于2年诉讼时效的规定。我国未来民法典继承编应当借鉴《意大利民法典》、《澳门民法典》明确规定继承回复请求权的性质。The requesting right of recovering inheritance is the initial requesting right when the heir is denied the right of inheritance by other people and is unentitled to possess the whole or part of the inheritance;it has the feature of the right of formation and the right of claim.The exercise of this right should be considered as the action of preserving inheritance and thus does not require the consensus of all heirs when the situation involves coinheritance.This right can be inherited and detained,but it cannot be subrogated because the appeal to this right requires the confirmation of the qualification of the heir.The requesting right of recovering inheritance is special requesting right.This right should be attached with application priority especially when the complaint and defendant are arguing over the inheriting qualification of the heir.In order to determine the property order in the minimum time,the requesting right of recovering inheritance should be submitted to the limitation of action,the period of which should adhere to the regulations of two-year limitation of action stated by the General Provisions of the Civil Law and Succession Law.The future civil code of China should learn from the civil law of Italy and Macao to clarify the nature of the requesting right of recovering inheritance.
