摘　　要：我国《物权法》第181条和第189条的规定表明物权法体系中引入了浮动抵押担保制度。从属于担保物权体系的浮动抵押制度虽然具有担保制度的共性,但是其个性更为突出,在制度构造、实现方式、法律效力方面都与现行的法律担保制度不同。因此,有必要从浮动抵押制度基本理论入手,阐释其内涵、价值等以完善浮动抵押制度。The provision of the Article 181st and Article 189th of Chinese Property Law indicates that the Floating Guaranty System has been introduced into the Property Law System.Although Floating Guaranty System,which is classified into assurance property system,has the general properties of assurance system,it still has a more distinctive characteristic.It is different from traditional assurance system in system structure,implementation and legal effectiveness.Thesis will start from the basic theory of Floating Guaranty System and study on the connotation and the value of this system to make it consummate.
