摘　　要：南京"彭宇案"的判决结果在社会上产生了广泛的影响,甚至被认为是社会道德滑坡的诱因。本文以此案为例,研究司法裁判的外部性问题。首先在法律市场的假设下讨论司法是不是一种商品,研究当事人与法院能否看做交易双方,进而探讨这一"交易"是否存在"外部性"以及"彭宇案"为何产生巨大的外部效应,最后讨论法官在处理这种案件类型时应如何考虑判决的外部性等问题。The judgment of ' Peng Yu' Case has extensive influenceto society,even considered as a remote cause of moral collapse. Taking it as an example,I will research the externality ofjudgments. First of all,on the assumption that there is a law market,I will discuss whether justice is a sort of commodity and whether we can consider litigants and courts as two parties of a trade. Then I will discuss whether there is externality of this trade. Third,what is the reason for the huge external effect of the' Peng Yu' Case. Last,I will try to answer how to consider about the externality of a judgement when the judge solve the similar case.
