摘  要:刑法的正当性或正当根据,是对我们为什么需要刑法和刑法存在在多大程度上合乎理性这一问题的回答,所以刑法的正当根据实际上是指刑法存在的合理性,即刑罚机制启动并运作的正当性。关于刑法的正当根据的论证,以往的刑法理论提供了两种方案,即报应论和功利论。学者们往往在报应与功利之间争论不休。本文试图提出一种忠诚理论来超越报应主义和功利主义。There has always been argument between the retributive and utilitarian theories over the legtimacy of punishment in the history of criminal law. The authors argue that both theories are far from sarisfaction: the former neglects the social and economic effects of punishment, while the later, to some extent, relinquishs the pursuit of social justice. In this article, the author try to formulate a new theory to synthesize these two different theories. They posit that in the modern state which governed under the rule of law, the legitimacy of punishment should be based on consensus among society's members that they will comply willingly with the dictates of criminal law.
