摘 要:一直以来,环境纠纷的行政解决机制都未引起学界的足够关注。调查发现,环境监察部门解决了社会生活中绝大多数的环境纠纷,且效果较好。进一步的实证分析显示,环境监察人员在纠纷解决中更喜欢采用行政命令或处罚方式,而非法定的调解,这与纠纷性质、受害人诉求、工作量与工作重心等一系列因素有关;环境纠纷的行政解决机制在实践中呈现出依附性、封闭性、状况性和决定性的典型特征。为使这一机制运作更加顺畅,可行的改革措施是填补立法空白,设置相对独立的纠纷解决机构,增加程序公开性和调解方式的运用,增强环境监测在纠纷解决中的运用以及区别对待纠纷解决结果的效力。The administrative resolution mechanism of environmental dispute has not drawn enough attention in the academia for a long time.Some investigations show that environmental monitoring departments have resolved the majority of environmental disputes in our society rather effectively.Further empirical analysis indicates that the environmental monitoring officers prefer administrative methods,such as order and penalty,rather than legal mediation.This is related to a couple of factors,such as the property of a dispute, appeal of the victim,working load and focus,among others.It sees characteristics as adherent,isolated,situative and decisive in the practice of administrative resolution of environmental disputes.In order to make administrative resolution mechanism of environmental dispute operate smoothly,the reform measures could be to fill the legislative gaps,set relatively independent dispute resolution organization,increase the openness of resolution procedure and the use of mediation manner,enhance environmental monitoring in dispute resolution as well as treat the effectiveness of dispute resolution results differently.
