摘　　要：民事执行检察监督,是人民检察院发现人民法院在民事执行阶段的诉讼活动违法,要求其予以纠正的一项监督制度。民事执行检察监督制度旨在通过检察权对执行权的制约来解决"执行乱、执行难"问题。2012年《民事诉讼法》的修订,明确了人民检察院对民事执行活动实行法律监督,基层检察机关处于监督前沿,在《民事诉讼法》并未明确规定执行监督具体操作规范的背景下,必须明确民事执行检察监督原则,进而在原则指导下结合实践探索完善监督范围、监督方式、监督运行程序,从而更好地履行监督职责。The system of inspection and supervision over civil-case execution is intended to settle the problems of 'execution in disorder and trouble'through the restriction of procuratorial right on execution right.The Civil Procedural Law revised in 2012 defines that the People's Procuratorate exercises legal supervision over civil-case execution while grass-root procuratorial organs are at watchdog edge.The new-edition Civil Procedural Law fails to state clearly that backgrounded by the specific operation norm of execution watchdog,the principle of inspection and supervision over civil-case execution must be made clear to explore and improve supervisory scope,manner and operation procedure in relation to practice under the guidance of principle so as to perform supervisory obligation better.
