宪法视野下公民宗教信仰自由保护研究——一种宪法权利、义务冲突的视角

摘　　要：宗教信仰自由是宪法赋予公民的一项基本自由。从宪法的角度来看,公民的宗教信仰自由应当予以保护并且在受到侵犯的时候能够及时寻求救济。从案例入手,引入域外经验,可从法律的角度探讨当公民的宗教信仰自由与其他宪法权利、义务冲突时如何平衡、救济的问题。Freedom of religious belief is a basic freedom endowed to citizens by the Constitution.From the perspective of Constitution,citizens' freedom of religious belief shall be protected and in a timely manner to seek relief at the time of violations.This article obtains from the case,the in the absence of Constitutional judicature of tradition in China,analyzes if citizen's freedom of religious belief and other Constitutional rights and obligations encounters confliction,how to seek remedy,to provide effective method to the protection of citizens' freedom of religious belief.
