On the Unincorporated Organizations'Civil Subject Qualification

摘　　要：非法人组织在实际生活中以不同的类型和形式发挥着重要的作用。但是非法人组织在我国民法上并没有取得和其作用相称的民事主体地位。通过分析非法人组织的概念和特征、民事主体资格的判定标准及人格和权利能力的联系,认为民事主体资格的认定应采权利能力说,权利能力为能否成为民事主体的前提条件。我国民法上应规定非法人组织为第三民事主体,并确以其准法人的性质。Though the unincorporated organizations play a very important role in different types and forms,these or- ganizations do not obtain the status of the civil subjects.Analyzing concept,features,standards of definition of the civil subject and the relationship between the person and capacity for civil rights,this paper holds that theories of capacity for civil rights should be adopted.The capacity for civil rights is the premise of civil subjects.The civil law should prescribe that the unincorporated organizations should be the third civil subject and the unincorporated orga- nizations should have the status of quasi legal person.
