农地发展权的本质、特征及其演化路径

摘　　要：产权的公共领域是产权及其权利束不能清晰排他而产生的权能利益的模糊空间。它可以分为第一公共领域和第二公共领域两类。两者相互影响的演化过程构成产权演化的全图景。农地发展权本质上是农地产权公共领域演化进程中逐渐得到清晰界定的排他性权利。我国的农地发展权具有鲜明的国情特征。国家垄断农地发展权本质上是国家创设的农地产权第二公共领域,是农地发展权演化的制度性障碍。The property's public domain is the property right and its right beam have the fuzzy space because of the lack of a clear and exclusive authority of the interests.It can he divided into two categories:the first public domain and second public domain.The interaction in these two categories evolution constitutes the entire picture of proper- ty's evolution.The right to development of agricultural land is essentially agricultural land property rights that have been clearly defined in the evolution proeess of the exclusive rights.Chinese agricultural development rights have a distinct national features.State monopoly of agricultural land the right to development is essentially the creation of the country's agricultural land in the second property in the public domain,and is the institutional obstacles to the evolution of the right of agricultural land development.
