摘　　要：从充分利用《建筑法》的修订、完善相关法规、严格工程担保公司市场准入条件和加强监管、解决留置权适用问题、将《招标投标法》中的履约保证金改为履约保证担保五方面提出完善工程保证担保制度法律环境的对策建议。This paper puts forward some countermeasures and proposals to improve the legal environment of project guarantee and bond system from five aspects: taking full advantage of the amendment of Construction Law, improving relevant laws and regulations, stricting market access condition of project bond company and strengthening supervision, solving the application of lien, changing performance security sum in Bidding Law into performance guarantee and bond.
