摘　　要：法的价值是指法作为一种规范体系或行为规则有哪些性状、属性、作用为人所运用、珍视、欣赏和追求;而法律行为价值是指法律行为对于法学研究、立法、司法、执法的意义和作用,创设"法律行为"这一法哲学意义上的概念,最终是服务于法学理论研究和法律实践的。法律行为的价值,包含客观与主观价值、应然与实然价值,本体与工具价值、理论与实践或适用价值。本文站在法哲学高度上提出并阐释了法律行为之理论与实践,具有七大价值:规范、识别、指向、本体、工具、体系和适用价值,这也为国内法学界之所鲜见。The value of law can be interpreted as the nature,character and effect of law as the system of norms and behavioral institutions,which can be utilized,cherished,appreciated and pursued by people,while the value of legal act is the significance and the effect of legal act concerning the legal research,legislation,judiciary and enforcement of law.The creation of the philosophical concept as legal act is to eventually serve for the research of legal science and legal practice.The value of legal act includes its objective and subjective value,the value as it is and value it ought to be,the ontological value and instrumental value as well as theoretical(logical structure of requirement and category classification system) and practical or applying value.This paper points out and interprets the theory and practice of legal act,grounded on the height of legal philosophy with seven kinds of values involving norms,identification and directing,noumenon,instrument,value about systematic and scientific trend and the application or practical value,which is uncommon within the circle of domestic jurisprudence.
