条约视角下钓鱼岛主权争端解决途径探讨  

On the Approaches to Resolving Sovereignty Dispute of Diaoyu Island: From the Perspective of Relevant Treaties

摘　　要：根据"条约必须信守"的原则,当事国中、美、日都应该遵守《开罗宣言》、《波茨坦公告》等这些国际条约确立的国际秩序。以钓鱼岛有关条约为研究视角,分析了《开罗宣言》、《波茨坦公告》和《旧金山和约》的实质;通过条约学理研究,探讨了条约对钓鱼岛争端当事国的效力,比较了国际法上解决领土争端的实践,对钓鱼岛主权争端的解决提出了几点思考。Under the principle of "treaties must be abided by",the parties,China,the United States and Japan should abide by the international order established by the international treaties the Cairo Declaration and the Potsdam Proclamation,which are the guidelines in handling defeated country Japan’s stealing Chinese territory after the Second World War.From the perspective of relevant treaties on the Diaoyu Island,this paper analyzes the nature of the Cairo Declaration,the Potsdam Proclamation and the San Francisco Peace Treaty.This paper also discusses the effectiveness of the treaties on the parties of Diaoyu Islands dispute through theoretical research on the treaties,compares international law practice of resolving territorial disputes and puts forward some suggestions for settling the dispute and concerning problems on the Diaoyu Island.
