摘 要:为了维护海域使用的秩序和保障海域使用权人的合法权益,行政法规对非法占用海域行为规定相应的行政处罚措施。而非法占用已出让海域行为存在着私权救济和公权管控的边界,即海域由国家所有,其权益由国家来主张,对海域进行管理和维护属于公权管控范畴,而对于已设置海域使用权的海域——国家出让海域给单位或个人,其权益由海域使用权人来主张,且权利保护方式属于民法上的私权救济范畴。具体到《海域使用管理法》,其中的第42条适用于非法占用国家所有、未经依法确权登记的、无具体用益物权所有人的海域的行为;第44条适用于非法占用已设置海域使用权的海域的行为。In order to maintain the order of sea area use and safeguard the lawful rights and interests of the holder of the right of use,administrative rules and regulations stipulate administrative penalty on illegal appropriation of sea areas.But in the cases of illegal appropriation of lawfully leased sea areas,there should be a clear boundary between private remedies and public right control.Sea areas are owned by the state,their rights and interests go to the state,and public right control has the authority and duties of the administration and maintenance of sea areas.In areas where the right to use has been arranged,i.e.leased to either units or individuals,the holder of the right to use can claim its rights and interests.The protection of the rights of the holder is subject to private right remedy of the civil law.Item 42of Sea Area Use Administrative Lawis applicable to illegal appropriation of state-owned sea areas where the right of use has not been lawfully arranged and registered and where no particular holder of rights has been lawfully specified.Item 44is applicable to cases where illegal appropriation occurs to sea areas lawfully leased.
