技术标准中专利权滥用的原因透视

摘　　要：专利技术与技术标准存在矛盾冲突,但二者的融合却已是大势所趋,也造成各种各样的标准专利权滥用问题,标准专利权滥用行为产生的原因主要包括观念、经济、制度、法律等方面的因素,主要是我国标准化方面的不足以及国际知识产权形势变化的影响。而要真正实现对标准专利权滥用的控制,则必须树立私权神圣和利益平衡两种基本法律观。Although the trend is inevitably toward consonance,inconsistency still exists between proprietary technology and technical standards that may lead to abuse of patented standards.The causal factors that lead to the abuse may be conceptual,economic,institutional,while some are legal problems,all as a result mainly of our insufficient standardization and the change of international proprietary situations.However,the two basic legal ideas of sacred private right and interests balance should be firmly implanted before real control of abuse of patented standards could be established.
