摘　　要：针对电子合同法律效力以及当前电子商务发展的障碍问题,提出了买卖双方和认证机构共同举证的对策。国家只有通过在法律解释中将电子签字概念加以明确和扩大,出台新型的电子商务法律法规,才能使电子合同的法律效力得到真正的发挥。先进的技术和政府的支持是建立网上贸易的重要因素,也为互联网交易平台营造了更加安全的环境。电子合同和第三方认证体系的成熟必将给电子商务带来新的腾飞。Against the issues of the legal validity of electronic contract and the current barrier to development of electronic commerce, this paper presents a countermeasure of giving evidences together by buyers, sellers, and the certification authority. By clarifying and extending the concept of electronic signature in the legal interpretation, the new electronic commerce laws and regulations can be established. In this way, the legal validity of electronic contract can be put into practice. Advanced technology and government support are the main factors in establishment of online trading and thus provicde a more secure environment for trading platform on the Internet.
