我国成年人监护制度缺陷与立法建议研究

摘　　要：以历史与逻辑相统一的方法,科学地分析了我国成年人监护制度的缺陷。主要表现在:立法观念上的滞后、立法体例上有违民法自身的逻辑性、内容上的不足等。同时提出了完善我国成年人监护制度的立法建议,即,成年人监护理念的纳新;立法体例的完善;扩大我国成年人监护制度适用的范围;引入任意监护制度,完善监护的设立方式;根据行为能力的不同设置不同层次的监护;具体规定成年人监护事务的内容,明确监护人的权利、义务,强化监护人的责任等。By historical and logical methods,this paper scientifically analyzes the flaws of adult wardship system in China.The main shortcomings are listed hereinafter:legislation ideas are out of date;legislation system is not consistent with Civil Law logicality itself;and content is not sufficient.Some legislative suggestions are stated in order to improve the adult wardship system:upgrading the ideas of adult wardship,improving the legislation,enlarging the applicable scope of adult warship system,introducing discretionary wardship system,ameliorating setting method of wardship,setting different level wardship according to different capacity for conduct,stipulating the content of adult wardship in details,confirming guardian's rights and obligations,and enhancing guardian's responsibilities.
