论民办高校章程的制定与完善

摘　　要：章程是民办高校依法成立的前件,也是其依法治校、自主管理的基本依据。充分认识民办高校章程的内涵与作用,是组织制定民办高校章程的重要基础。从调查情况看,现有民办高校章程存在制定主体不明确、制定依据不充分、内容要件不齐全以及制定程序不规范等八大问题。本文认为,制定和完善民办高校章程,必须遵循主体明确、依据充分、要件齐全、权责对等和程序公正原则,并结合实际,就如何完善民办高校章程,提高章程实施及执行效率,提出了五项对策措施。The constitution is a prerequisite for the establishment of private institutions of higher learning as well as the fundamental basis of the governance and self-management of the institutions according to the law.To fully understand the meaning and role of the constitution is the important foundation for private institutions of higher learning to organize their constitutions.The survey shows that the existing constitutions of private institutions of higher learning exist mainly eight issues such as uncertainty of the development the constitutions,the development of the constitutions not based on the full and complete basis,the content and elements of the constitutions lack of necessary parts and the procedures of the development far from being regulated.This paper figures out that the development and improvement of the constitutions of private institutions of higher learning must follow the principal as clear target,full and complete basis,necessary content,equal rights and responsibilities and the impartiality of the procedures.Meanwhile,relating to the reality,five implementation measures are proposed in the paper in order to improve the efficiency of the implementation in the field of the perfection the constitutions.
