摘　　要：近些年来,我国因产品质量引起的事故有增无减,严重地侵犯了消费者的人身和财产权益,传统民法的契约和侵权法律制度并不能有效地予以保护。在国外,法律实践发展出了产品责任这一新型的责任制度体系,我国也初步建立了产品责任法律制度,但还存在一些不尽如人意的地方,有必要借鉴国外立法和司法的先进经验来完善立法,以促进企业加强质量管理,应对国外企业的竞争,有效保护消费者权益。The accidents caused by product quality are increasing continuously in these years, which seriously infringe the physical and property rights of consumers, Consequently, the traditional legal system of civil contract and infringement conduct cannot be protected effectively. However, in foreign countries, the legal practice has developed a new typical liability system-product liability, and our country has also set up the system primarily, but not perfectly. We must use the advanced experience of other countries as reference to improve our legislation and to strengthen our enterprises’ quality management, which will be propitious for the enterprises to face the competitions from overseas rivals and for the consumers’ rights protection.
