浅析公安机关执法中的赔偿责任

摘　　要：我国公安机关既是具有武装性质的治安行政机关,又是具有刑事侦查权的司法机关。它的职权范围非常广泛,其执法活动涉及到公众利益、公民的人身自由和财产权利,也关系到政府的形象,关系到我国的法治建设。根据我国的宪法、国家赔偿法和人民警察法的规定,公安机关在执法过程中,违法行使职权,侵犯公民、法人或者其他组织的合法权益,要承担赔偿责任。赔偿责任包括行政赔偿责任和刑事赔偿责任。公安机关必须严格执法,提高执法水平,维护公安机关的执法权威,树立良好的执法形象。The public security organs in China is the public order administrative department with armedcharacteristics and is also the judicial organs with the crime investigation powers.It has a wide range of powersand authorities.Meanwhile,its activities in the law enforcement are concerned with not only the public interests,citizens'personal freedom and his property rights but also the government's image and the legal systemconstruction of our country.According to the 《CONSTITUTION》,《NATIONAL COMPENSATIONAL LAW》andthe《PEOPLE'S POLICEMEN LAW》,the public security organs should undertake the compensationresponsibilities if it executes its powers illegally,or intrudes upon the legal rights and interests of the citizens,legal persons and other orgnizations when in the law enforcement.The compensation responsibilities include theadministrative one and the criminal one.In order to improve the quality of the law execution,maintain itsauthorities and establish its good image,the public security organs must execute the law strictly.
