商议式司法视域中的农村解纷模式研究

摘　　要：商议式司法是当事人各方以沟通理性为指导,抛弃单纯对抗,通过商谈与合作解决矛盾纠纷,消解违法犯罪行为,寻求共识的解纷模式。中国农村解纷的商议式模式基本特征在于以主体间的沟通互动为基础,遵循合理性的司法程序,并强调法律因素和道德因素的互补。实践中它表现出较为广泛的类型,并依次呈现出不同的层次和领域。Deliberative justice is a rural resolving dispute where the parties communicate in the communication rationality guidance,abandon simply confrontation,seek consensus and resolve conflicts and criminal acts through negotiation and cooperation. In China rural resolving dispute characterized by communication and interaction between the main participants,abiding by reasonable judicial procedure and emphasizing combination of legal and ethical considerations. In practice it exhibits relatively wide types and presents different levels and fields in turn.
